Employment Tribunal fees to go ahead …for now!

The Government’s controversial plans to implement a fee system from 29th July 2013 got the green light on Thursday 11th July?after an attempt by Fox Solicitors to halt the introduction failed in the Scottish Court of Session.

However, the Judge in refusing the interdict, stated that the matter should proceed to a full hearing later this year (possibly October).

Meanwhile, the Lord Chancellor gave a commitment that if the fee system was later overturned then fees paid from the date of implementation would be refunded.

Elsewhere, south of the border, in the initial application for a Judicial Review made by UNISON, the Judge agreed to speed up the review application and a decision on whether permission is granted is due next week.

If permission is granted (which appears fairly probable) then consideration of deferring the implemention will be given.

Tribunal fees apply to all new claims from the above date including? unfair dismissal,?breach of contract, unlawful deductions, all types of discrimination?and whistleblowing.
